Contracting with Confidence: Employment Law Attorney Scott Mirsky Presents Webinar on Independent Contractor Agreements

On June 15, MM&C employment law attorney Scott Mirsky was featured in a webinar titled “Contracting with Confidence: Independent Contractor Agreements”, hosted by the SE Asian Languages Special Interest Group (SEAL SIG) of the American Translators Association. The webinar educated participants on the various rules and laws surrounding independent contractor agreements, impacting a variety of industries. Mirsky explained the difference between an independent contractor and employee and provided tips on structuring independent contractor relationships. Organizations working across multiple jurisdictions are impacted by laws on federal, state and local levels, adding to the complexity. “Understanding the nature of these agreements and structuring them correctly is critical to ensure organizations are in compliance and follow IRS and Department of Labor regulations to mitigate challenges,” Mirsky said.  As part of his presentation, he identified several factors that define independent contractor status, including where the work is performed, whether benefits are offered, the permanency of the professional relationship and other factors, adding that a comprehensive assessment of a working relationship is key to accurate categorization.
