Telecommunications / Zoning Approval for Out of State Wireless Company

Issue:

An out of state wireless infrastructure development (cell tower) company retained Sean in mid-December.  The client needed expedited and quality legal assistance on a crucial project in Maryland.  The client’s anchor tenant required final County zoning approval within 3 months for the new cell tower. Otherwise, the anchor tenant would need to abandon the project and locate to another nearby site thus cancelling the client’s well-invested project.

Goal:

The client and Sean developed an accelerated plan and schedule to meet and work closely with the local jurisdiction, its property owner and the entire development team. The plan required the preparation, submittal and acceptance of the Conditional Use land application for the new cell tower in January, public hearing by the Planning Commission in February and final zoning review and approval by the Board of Appeals in March.

Success:

The close partnerships paid off and the tight schedule was met. The successful timing allowed the client to retain its anchor tenant and later add a second tenant to the facility.
