Diane E. Feuerherd

Diane Feuerherd is an associate in Miller, Miller & Canby's Litigation practice and focuses her practice in appellate, commercial and business litigation. She joined the firm in 2013, after serving for two years as an appellate law clerk to the Honorable Lynne A. Battaglia of the Court of Appeals of Maryland, the State's highest court.


Ms. Feuerherd has successfully represented individuals, property owners, and businesses in a variety of matters ranging from administrative hearings before the Board of Appeals of Montgomery County to trials in state and federal courts and appeals before the Court of Special Appeals and Court of Appeals, including:


Montgomery County v. Phillips, 445 Md. 55 (2015): Before the Court of Appeals of Maryland, Ms. Feuerherd briefed and argued on behalf of owners of a family farm, and persuaded a majority of the Court that Montgomery County overcharged its farmland transfer tax in violation of the state tax cap.

Chod v. Montgomery County Board of Appeals, Circuit Court for Montgomery County, Case No. 398704-V: On behalf of a local commercial property owner, Ms. Feuerherd challenged the Water Quality Protection Charge (also known as a "rain tax"), through the administrative appeals process to a successful appeal in the Circuit Court for Montgomery County.


For her achievements, she has been named a Maryland Rising Star by the Super Lawyers publication, for 2016 and 2017. The Rising Star honor annually recognizes achievements of attorneys under the age of 40. 


Ms. Feuerherd is active in state and local bar associations, including:  the Maryland State Bar Association, where she was named a Fellow of the prestigious Leadership Academy and now serves on the Judicial Appointments Committee; the Bar Association of Montgomery County; and the Montgomery County Inns of Court. In 2016, she was appointed to a social media workgroup for the Judicial Council, which is a policy advisory body to the Maryland Judiciary. She has also worked with the Finding Justice Project, a committee of the Women's Bar Association Foundation, to research and memorialize the history of women lawyers, and proceeds from the resulting publication, Finding Justice: A History of Women Lawyers in Maryland since 1642, now fund law school scholarships.


A native of Montgomery County, Ms. Feuerherd graduated summa cum laude from the University of Baltimore School of Law. While in law school, she served as Production Editor for the Law Review; captain of two award-winning moot court teams; and a Law Achievement Scholar, providing tutoring to first-year law students in Contracts courses. Her work as a student attorney in the school's Civil Advocacy Clinic earned her the national Clinical Legal Education Association (CLEA) Outstanding Student Award.
